Terms and conditions
These terms and conditions (the "Terms") govern access to and use of the AI API service published by Mazlo (the "Service") by any business customer (the "Customer"). They prevail over any purchasing terms of the Customer unless otherwise agreed in writing. This English version is provided for information; the French version prevails.
1. Business customers only
The Service is reserved for professionals acting for the purposes of their business. By creating an account, the Customer declares that it acts as a professional. Consumer-protection provisions do not apply.
2. Account and API keys
The Customer creates an account and obtains API keys. It is responsible for keeping its keys confidential and for any use made with them. It notifies us without delay of any compromise; we then revoke the key.
3. The Service and the zones
The Service gives access, through an OpenAI-compatible API, to models run in the zone the Customer chooses:
- EU zone: run at hosts located in the European Union;
- CH zone: run in Switzerland;
- Proxy zone: run at the model's vendor, outside the European Union.
The zone is set per key and may be narrowed per request, never widened. We commit never to run a request outside the zone the key allows, and to record in the crossing log the zone and model actually used.
Dynamic models are served by a model of our choosing, never outside the perimeter their name states. Which models serve them, and in what order, is our know-how: it is not disclosed and may change without notice, within that perimeter and at the listed price. For these models, the crossing log records the zone and country of processing.
4. Prepaid credits and prices
The Service is paid in advance by buying credits in euros. Each request is deducted at the price in force for the model and zone used, as shown on the pricing page at the time of the request. Prices exclude taxes; applicable VAT is added on the invoice.
- Minimum purchase: €10 excluding VAT.
- Credits are valid for 12 months from purchase. Credits unused at expiry are lost.
- Credits are neither refundable nor convertible into cash, except on termination by Mazlo without fault of the Customer (section 10) or breach by Mazlo of its obligations.
- The welcome balance given when the account opens is usable on open-weight models in the EU and CH zones, is not refundable, and may be withdrawn in case of abuse.
We may change our prices. Any increase is announced by email at least 15 days before it takes effect and applies only to later requests. Proxy model prices follow their vendor's and may be adjusted at shorter notice when the vendor changes its own prices.
5. Payment and auto top-up
Credits are paid by card through our payment provider or, from €500 excluding VAT, by SEPA transfer against an invoice. Credits paid by transfer are available once funds are received.
The optional auto top-up buys the amount the Customer chose when its balance falls below the threshold it set. The Customer may switch it off at any time. It is switched off automatically when a payment is declined.
Any amount unpaid when due bears interest at the European Central Bank rate plus 10 points, and gives rise to the €40 fixed collection fee provided by article L.441-10 of the French Commercial Code.
6. Invoices
Each credit purchase gives rise to an invoice issued by Mazlo, delivered electronically in line with French e-invoicing regulations. The Customer provides accurate billing information, including its EU VAT number, checked against the VIES system.
7. Acceptable use
The Customer undertakes not to use the Service:
- for a practice prohibited by article 5 of Regulation (EU) 2024/1689 on artificial intelligence;
- to produce, distribute or facilitate illegal content or activity;
- to circumvent the usage policies of model vendors, in particular for proxy models;
- in a way that harms the security or availability of the Service.
As a deployer within the meaning of the AI Regulation, the Customer remains responsible for the obligations that apply to its own systems and uses. Mazlo provides information and logs that help document them, without fulfilling them on the Customer's behalf.
8. Availability
Mazlo uses reasonable means to keep the Service available, without a guarantee of continuous availability unless a service-level commitment is agreed in writing. Maintenance interruptions may occur; we announce them in advance where possible.
Model outputs are generated automatically and may be inaccurate. The Customer is responsible for checking them and for the use it makes of them.
9. Personal data and confidentiality
For content sent to the API, Mazlo acts as a processor under article 28 GDPR, under the data processing agreement that forms an integral part of these Terms. Mazlo does not keep that content beyond processing it and never uses it to train models.
Each party keeps confidential the other party's non-public information it learns under the contract.
10. Term, suspension and termination
The contract is concluded for an indefinite term. The Customer may close its account at any time.
Mazlo may suspend a key or an account without notice in case of serious breach of these Terms, in particular section 7, or of risk to the security of the Service. Mazlo may terminate the contract with 30 days' notice; in that case, and absent fault of the Customer, unused credits are refunded.
11. Liability
Mazlo's liability, on any ground, is limited to the amounts paid by the Customer in the twelve months preceding the event giving rise to it. Mazlo is not liable for indirect damage, such as loss of revenue, customers or data. These limits do not apply in case of gross negligence or wilful misconduct.
12. Intellectual property
The Customer keeps all rights in the data it sends and in the results obtained, within the limits of third-party rights and model vendors' terms. Mazlo keeps all rights in the Service.
13. Changes to the Terms
Mazlo may change these Terms. Any substantial change is notified by email at least 30 days before it takes effect. A Customer who refuses it may close its account and obtain a refund of its unused credits.
14. Governing law and jurisdiction
These Terms are governed by French law. Any dispute about their interpretation or performance falls under the exclusive jurisdiction of the courts of Paris, including where there are several defendants or third-party claims.
The French version of these Terms prevails over any translation.
